The VALENTINO Group (the collective corporate entity comprising VALENTINO S.p.A. and VALENTINO USA Inc.) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy (the “Policy”).

The Policy describes our practices for collecting, using, maintaining, protecting, and disclosing that information when you:

• access and visit the Website, even if you do not purchase the products sold on it;
• send or receive emails, texts and other electronic messages between you and us (“Electronic Communications”);
• visit and interact with us at our Stores; or

This Policy may change from time to time (see ‘18. CHANGES TO OUR PRIVACY POLICY’), so we encourage you to review it regularly. Your continued use of this Website after we make changes is deemed to be acceptance of those changes. 

1. WHO COLLECTS AND PROCESS DATA

We engage in various activities in relation to the handling of data collected and processed through the Website, through:

• VALENTINO S.p.A. as the sole data controller responsible for processing: (i) the personal data of Website users, including browsing data, marketing data and profiling, and (ii) the personal data exchanged through Electronic Communications;
• VALENTINO S.p.A. and VALENTINO USA Inc. as joint controllers for data processing related to the sales made through: (i) the Stores, and (ii) the E-Store on the Website, and to the related pre and post-sales support activities. 

VALENTINO has appointed a data protection officer (“DPO”) to ensure that we process personal information in compliance with applicable privacy laws, who can be contacted at the following e-mail address: privacy@valentino.com.

2. TYPE AND PURPOSE OF PROCESSING PERFORMED ON THE WEBSITE 

The data we collect and process through the Website, including Electronic Communications, or in our Stores vary. We process your data for various purposes and with different methods, as described below. 

Processing through Valentino S.p.A.

(a)  Cookies - The data concerning your browsing of the Website are processed to ensure that the Website works properly and for marketing purposes. Please also refer to our Cookie Policy. The Website uses the following cookies:

Necessary/Technical Cookies - These cookies enable the Website to function correctly, allowing users to view its contents in the respective language and market from their initial visit. This is the primary purpose of these necessary/technical cookies. They can identify the user’s country of connection and ensure automatic redirection to the appropriate version of the Website for their country upon each visit. Additionally, they facilitate account creation, login, and order management. For registered users, the Website can recognize them when accessing services offered exclusively to registered users, thanks to these cookies. Furthermore, these cookies can detect if users purchase products on the Website through affiliated or partner sites such as Tradedoubler and Rakuten, enabling us to fulfill our obligations related to such partner sites (thus fulfilling our commitment linked to the purchase). These cookies are necessary for the Website’s operation.

Analytic Cookies - These cookies are utilized to generate statistical analyses concerning how users navigate the Website, including the device used, the quantity of pages visited, or the number of clicks on a specific page during navigation. The outcomes of these analyses are processed anonymously and solely for statistical purposes. Therefore, the purpose of the processing is to produce statistical aggregated analyses regarding the usage of the Website. 

Profiling Cookies - The Website utilizes profiling cookies, which enable the tracking of preferences observed during each visit. This allows for the creation of profiles that facilitate the sending of messages tailored to users' preferences and interests. For instance, it may expedite the process of finding desired products or recommend similar items. Furthermore, these cookies may enhance the existing client profiles within our databases, enabling us to offer personalized services and experiences. The primary purpose of this processing is analysis and profiling, with the legal basis being the user's consent.

Cookies for marketing and retargeting purposes (first and third party) - These cookies are employed by trusted first and third parties to showcase banner advertisements on affiliated sites (retargeting), featuring products recently viewed by users. As users navigate the Website, these cookies additionally suggest other products that may pique their interest or items similar to those recently viewed, based on their browsing history. Additionally, these cookies may be used for enhanced conversion activities, where collected data is hashed to ensure privacy. The purpose of this activity is marketing, with the legal basis being the consent provided by the user.

(b) Web Beacons or Tracking Pixels - A web beacon, or tracking pixel, is a small image file on a web page that may be used to collect certain information from your device for the purpose of keeping track of user behavior, web traffic, site conversions, and enhanced conversion. This information may include the IP address, time of access, browser, and identification of cookies. On the Website, we use beacons and tracking pixels for several platforms, including Adobe Analytics, Google Ads, Tik-Tok and Contentsquare. With your consent, we or our vendors, may utilize web beacons to track visitor statistics to the Website and manage cookies, as well as help inform advertisements on third-party platforms. This includes activities related to enhanced conversions, particularly in collaboration with Google, Meta, and TikTok, where hashed user data may be used to improve the accuracy of conversion tracking based on activity tracked from your browser or device. Additionally, these tools help identify return traffic from third-party platforms such as social media applications, and for third-party web analytics.

(c) Log Files and Browsing Data - This information is sent automatically to us by your browser each time you visit the Website. The transmission of this information is not dependent on the presence or use of cookies and is unaffected by your opt-in or opt-out election concerning cookies. These logs may contain information such as the Internet domain from which you access the Website; the date and time you visited the Website; the areas of the Website that you viewed; your computer’s IP address that is automatically assigned when you log onto the Internet; the type of browser and operating system you use; the address of the website you came from, if any; and the webpage addresses requested by or sent to you.

(d) Other tracking technologies – With your consent, we or our vendors may also use other tracking technologies, including, but not limited to mobile advertising IDs, tags and scripts to collect information about your visits to the Website and your behavior while on the Website. This information is used for improving user experience, to deliver targeted advertisements to you across the internet based on your Website usage, and for enhanced conversion.  They are also used to inform us or our vendors when an advertisement they run on another website has been clicked on by users, and use that information to judge which advertisements are more appealing to users.

(e)  Registration and Services - Any data that you voluntarily provide to us (including, but not limited to, your email address, personal details and information, the password you chose while filling in the registration form of your personal account with us, any wish list that you create and financial account information for purchases, or the data that were lawfully acquired in any other manner, including by telephone or online contact request form when you contact our customer service department for information about our products and services), are processed for acknowledging receipt of your requests, delivering the service you requested and providing you with all necessary assistance and information in relation to our products and services. Please note, in this regard, that with your explicit consent at the beginning of the call to our customer service, the call may be recorded to enable Valentino to monitor the service offered to customers. All personal information you submit to us during registration must be true and accurate at the time of registration. Users are required to update their personal information if any changes occur by logging into their personal account online. We also process any data that you provide to us through the Website regarding your work and study experience to evaluate any job application that you have submitted to us. 

Please note that registration, access and other interactions with us, such as surveys, through messaging apps (including, without limitation, WhatsApp) or other services, may involve the disclosure of personal data (first and last name, telephone number and any other data relating to the user and available through the messaging app) by the messaging app or service and by us to the messaging app or service.

(f) Location Data - We utilize a feature that, when you access the Website by or through a mobile device or through your browser, accesses, collects, monitors and/or remotely stores location data, and may include GPS coordinates (longitude and latitude) or similar information regarding the location of your device. This data may be used to convey information about how you browse and use the Website, as well as to provide you with personalized information based on that location data. You may opt-in or opt-out of sharing location data from your device.

(g) Social Media Network Log-In - Please note that registration and access through a social media profile will involve the disclosure of certain personal data (including first name, last name, email and any other data relating to the user and present on the same Social Media Network). Therefore, we require your explicit permission before you log in to your personal account using the social log-in. In some cases, social networks require some feedback and information about the use of the social media network log-in. For more information please refer to the relevant privacy documentation on the social network. 

(h) Marketing - By giving your express consent, which is also obtained when you make a choice regarding cookies as detailed in our cookies banner, you will allow us to process your data  for marketing purposes, namely, for sending you information and updates on products, sales, surveys, promotional campaigns, events and other initiatives promoted by us, through postal mail, telephone, newsletters, e-mails, text messages, MMS and smart messages, including WhatsApp. 

Such communications might also include messages suggesting to complete purchases on hold , in the form of reminders on products viewed and abandoned carts, as well as communications aimed at verifying your satisfaction and the quality of service provided to you by us; 

(i) Analysis: As detailed in Section 7. below, by giving your express consent, we may process your personal data (e.g. data related to your purchases and preferences) to study shopping habits and choices. This allows us to make products and initiatives more responsive to your tastes and needs, offer each customer the products and experiences most relevant to their preferences, and to analyse the commercial impact and return of marketing campaigns.

(j) Fraud Prevention - Please note that we may process your data (such as identification data, payment data, localization, purchase data) for the prevention and suppression of fraud and/or of illegal behaviour or behaviour that is contrary to current regulations, applicable contractual provision, as well as fairness and good faith. Such processing may also be carried out by third parties, such as companies specialized in the identification of online fraud, public authorities, investigative bodies, police officers and judicial authorities.

(k) Online Purchase and Pre- and After-Sale Assistance. Please note that we may process any data that you have provided to complete a purchase (such as personal details, purchase data, delivery and contact details, payment preferences and data related to specific pre e post sale requests) in order to process and complete your purchase of products on the E-Store. Such activities include all interactions we deem necessary for the sale, as well as for any pre- and after-sales activities and assistance, and related services, including those provided in Stores worldwide. These activities encompass aspects concerning return rights, statutory and contractual guarantees and product assistance.

3. DO NOT TRACK

Some web browsers have “Do Not Track” features that allow you to tell a website not to track you. These features are not all uniform. The Website does not currently process or respond to “Do Not Track” signals.

4. TYPE AND PURPOSE OF PROCESSING PERFORMED WHEN YOU VISIT OUR STORES

Information You Voluntarily Provide to Us

We may collect personal information from you when you visit our Stores or use it for the purposes noted below.

(a) Purchases and Services.  When you purchase our products or obtain assistance in our Stores, we collect the information necessary to process your purchase or to furnish the assistance that you requested. We may collect, to the extent permitted by applicable law, information such as your name, billing and/or mailing address, telephone number, identification number (such as driver’s license, ID card or passport number) and payment details (such as a checking account, credit card or debit card number). We may also collect information about the items you purchase, including the purchase price and payment method, to furnish the products and services to you and to communicate with you and for marketing purposes.

(b) Customer Satisfaction Surveys.  When you purchase our products or obtain assistance in our Stores, we may ask you to take a customer satisfaction survey. If you have granted consent, this invitation may be sent also via email or WhatsApp. We may use the information you provide to us in a survey to improve our products and services and to communicate with you.

(c) Customer Service.  You may contact our customer service department by telephone for information about our products and services. During your call, we may ask you to provide us with certain demographic information, including, but not limited to, your name, address and telephone number. We may use the information you provide to our customer service department to respond to your request and to process any purchase that you may make with us by telephone. With your consent given at the beginning of the phone call, the call may be recorded to enable Valentino to monitor its service offered to customers

Information Collected Automatically

We may collect, to the extent permitted by applicable law, certain personal information automatically when you visit our Stores as noted below.

(d) Cameras. We may use cameras, sensors, digital recordings, photography and/or other similar technology to monitor our Stores for any lawful purpose, including to deter theft, to provide security and to operate the Stores. We may also collect images that show how you move through a Store so that we may analyze traffic patterns to determine whether to change the layout of the product displays in the Store and to otherwise improve a shopper’s experience in our Stores.

(e) Wi-Fi Data Analytics. We may use technology provided by one or more third-party service providers that detects and analyzes Wi-Fi signals (or other technology such as Bluetooth) from your mobile devices, including smartphones or other wireless devices, to determine traffic patterns and gather other statistical information about shoppers in our Stores. The technology used for such analysis identifies your mobile devices by their device identifiers; however, the service provider obscures the devices’ identifiers by hashing them prior to undertaking its analysis. We receive only aggregate statistics about shoppers in our Stores from the service provider and use that information to improve a shopper’s experience and for operational purposes.

Our products are available at certain retailers in the United States (a “Third-Party Retailer”). This Policy does not apply to the manner in which a Third-Party Retailer collects, uses, maintains and discloses personal information that you provide to the Retailer when you shop at its store. Please review the Third-Party Retailer’s privacy policy for information about the Retailer’s use of your personal information. We are not responsible for the privacy policy of any Third-Party Retailer.

5. LEGAL BASIS FOR THE PROCESSING

The data are collected directly from the user with the exception of: 

• data collected with navigation (such as via cookies, log file or web beacons); 
• data collected with the social media network log-in;data collected for fraud prevention purposes; and
• images and other data gathered by cameras in our Stores

7. ANALYSIS OF USER'S BUYING HABITS AND SELECTIONS 

We may also process the user's personal data, whether acquired on the Website or in our Stores, for the purposes of analysing user's buying habits and selections, in order to make  our products, services and initiatives more responsive to our customers' tastes and needs. 

We will process, by automatic means, the value purchased within a framework of time, the frequency of the purchases (even if the purchases are made during the sale period) and the kind of product purchased (accessories, clothes, haute couture, pret-a-porter). We will not proceed with an intrusive study of the users’ behaviour, and the study is only intended to propose to clients and users products, services and initiatives more responsive to their tastes and needs. 

Moreover, please note that with the user's express consent given on the Website’s cookies banner, we can process personal data through an automatic means to study cookies. This analysis helps verify the user’s navigation through the Website and to propose products and services in line with the navigation. In connection with this, we may also engage in enhanced conversion activities, where any personal data used for this purpose is hashed to ensure privacy, thereby improving the accuracy of our analysis while protecting user information.

8. PERSONAL DATA PROCESSING METHODS CARRIED OUT BY US

The personal data collected through the Website and by cameras and/or by Wi-Fi, is primarily processed using computer and electronic means, adopting security measures in order to reduce to a minimum the risks of destruction or loss, including accidental loss,  unauthorized access, unlawful processing, or processing that is not compliant with the purposes of collection indicated in this Policy. 

However, these measures, due to the nature of the online transmission method, cannot limit or completely exclude the risk of unauthorized access, or dissemination of data. To that end, we recommend that you periodically verify that your computer is equipped with the appropriate software devices to protect from the transmission of incoming and outgoing data on the network (such as up-to-date antivirus systems) and that your Internet service provider has adopted adequate measures to ensure data secure transmission of data on the network (such as, for example, firewalls and antispam filters). 

9. MANDATORY OR VOLUNTARY NATURE OF PROVIDING DATA

With the exception of the navigation data (e.g. some cookies (governed by our Cookie Policy), web beacons and log file information), data gathered for fraud prevention purposes)  and of images and other data gathered by cameras in our Stores, the provision to us of personal data, both for requests and queries, and for the purposes of marketing and analysing consumer habits and preferences, is voluntary and optional. Failure to provide such data does not limit the use of the Website, although it may make it impossible for us to respond to requests (including pre and after sales assistance requests) for information and queries, or to furnish customized products and services, or to send informational material, updates, newsletters and invites to our events.

The provision of some of your data, such as personal details, email address, postal address, telephone number and bank details in case of credit card payments, is essential to process your order.

Some of your data, moreover, may be necessary for providing you other services made available on the Website in connection with the sales (e.g. post sales and pre sales services such as made to measure services, pickup in Stores service, delivery, exchange, etc.) or for discharging our legal and/or regulatory obligations (such as tax obligations and anti-money laundering). If you fail to provide us with the necessary data we request, we might not be able to process the purchase and/or provide the related services.

The mandatory or voluntary nature of the data to be provided will be indicated by means of a special character (“*”), placed next to the relevant information.

10. CATEGORIES OF RECIPIENT OF PERSONAL DATA

We may disclose your personal data as indicated below:

• To the other companies belonging to the VALENTINO Group;
• To our employees and consultants.
• To companies which, acting in their capacity as data processors, provide to VALENTINO and VALENTINO US specific technical and organizational services in relation to the Website and to the management of marketing and communication activities and Customer Service activities.
• To third parties approved by the consumer (including social media such as Meta Inc. and Google Inc.).
• In the event of a change in ownership or control, such as a sale or merger.
• To police officers and judicial authorities, in compliance with the law and upon their request, or in case there are good reasons to believe that such disclosure is reasonably necessary to (1) investigate, prevent or take initiatives in relation to suspected unlawful activities, or assist national supervisory authorities; (2) prepare a defence against third party claims or charges, protect the security of its own website and of the company; (3) exercise or protect the rights, property or security of VALENTINO, VALENTINO US, the VALENTINO Group companies, its affiliates, customers, employees and third parties.

Certain data collection and processing on our Website may be deemed by applicable state laws as a “sale” or “sharing” of personal information. For example, the personal identifiers and usage data collected by the cookies, web beacons and log files may be shared with our analytics vendors and partners (such as Meta, Google, TikTok, and Contentsquare) that may use such information for the purposes of targeted behavioural advertising and enhanced conversion across different platforms. Such disclosure is treated as a sale of personal data in certain jurisdictions. To submit a request to opt out of the sale or sharing of your personal information, you may  send an email to privacy@valentino.com with the subject line “Do Not Sell or Share My Personal Information”, specifying your full name and email address associated with your account or interactions with VALENTINO.

11. CROSS-BORDER DATA TRANSFER

Your personal data will be transferred abroad only if adequate levels of protection and sufficient safeguards, as provided for by the law, are guaranteed, such as Standard Contractual Clauses (please see here the relevant standard as approved by the EU Commission) and prodded with a data transfer impact assessment, in order to protect the transferred personal data.

12. STORAGE PERIOD

Personal data collected and processed by the Website will be stored for the period of time indicated here below, after which the data are technically deleted or rendered totally anonymous using means that prevents it to be recovered. We may retain your personal information for a longer period if there are valid legal grounds for doing so, for example, in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

13. USER RIGHTS RECOGNIZED BY THE PRIVACY LAW

Depending on the applicable law of the state of your residence, you may be entitled to obtain confirmation of whether or not personal data concerning you exists in our possession, even if it is not yet recorded, and to have it communicated to you in an intelligible form. You may also have the right to obtain information about (i) the source of personal data, (ii) the purposes and methods of processing it, (iii) the logic applied for processing through electronic instruments, (iv) the details of the controller and data processors.  You may also be entitled to obtain information on the persons or categories of persons to whom your personal data may be communicated, directly or indirectly (such as data processors or agents as data supervisors or data processors). You may also have the right to request an update, correction and/or, in specific cases, deletion, anonymization, or the blocking of your data, if your data have been processed unlawfully, or if your data is not necessary anymore for the purposes for which it was collected.

Furthermore, you may have the right to obtain certification that the above actions have been notified, as also related to their contents, to the entities to whom or which the data were communicated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. In some cases, you may also ask for the portability of your data, and you have the right to withdraw the consent previously given.

Your rights regarding your personal data depend on the rights provided under the laws of the state of your residence. If a right is not provided to you under such laws, we have absolute discretion on whether to provide you with such rights.

Please finally note that you have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali), based in Piazza Venezia, 11, 00187 Rome (www.garanteprivacy.it), or with another data protection supervisory authority in the Country in which you reside.

15. DATA SECURITY

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the electronic transmission of information is not completely secure. Although we do our best to protect your personal information, either on the Website or at our Stores, we cannot guarantee the security of your personal information transmitted electronically.

Any transmission of personal information is at your own risk. On the Website, we are not responsible for circumvention of any privacy settings or security measures.

16. YOUR STATE PRIVACY RIGHTS

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California (see Privacy Notice for California Residents), Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia provide (now or in the future) their state residents with rights to:

• Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

• Opt-out of personal data processing for:
• Targeted advertising (excluding Iowa);
• Sales; or
• Profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
• ·Either limit (opt-out of) or require consent to process sensitive personal data.

The exact scope of these rights may vary by state, and we may not be subject to one or more of these state privacy laws. To exercise any of these rights please send us a request, to the attention of the DPO, at privacy@valentino.com.

Shine the Light Law - California Civil Code §1798.83 permits residents of California to request certain information about our disclosure, if any, during the prior calendar year of your personal information to third parties for the third parties’ direct marketing purposes. We did not disclose customers’ personal information to third parties for their direct marketing purposes in the last year.

17. CHILDREN UNDER THE AGE OF 16

The Website is not intended for children under 16 years of age. No one under the age of 16 may provide any information on the Website. We do not knowingly collect personal information from children under the age of 16. If you are under the age of 16, do not use or provide any information on the Website, register on the Website, make any purchases through the Website or provide any information about yourself to us, including your name, address, telephone number, email address or any other personal information. If we learn that we have collected or received personal information from a child under the age of 16, we will delete that information.

18. CHANGES TO OUR PRIVACY POLICY

It is our policy to post any changes we make to our Policy on this page. The date the Policy was last revised is identified at the top of the page. PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice supplements our U.S. Privacy Policy and applies solely to the processing of the personal information of California residents. Please note that we can deny a CCPA-related data access or data portability disclosure request if you already made such request twice within a 12-month period.

If you choose to contact us directly by phone or email to exercise your rights, you must provide us with: (i) sufficient information for us to identify you; (ii) proof of your identity and address (e.g., a copy of your driver’s license or passport and a recent utility or credit card bill); and (iii) a description of what right(s) you want to exercise and the information to which your request relates.

We are not obligated to satisfy a request for a data access or data portability disclosure, or to correct personal information, if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.

Any personal information we collect from you to verify your identity in connection with you request will be used solely for verification purposes.

You may designate an authorized agent to exercise your rights under the CCPA. If you utilize an authorized agent to exercise a right, you must furnish the following proof that you have authorized the agent to act on your behalf:

• Your written permission for the authorized agent to act on your behalf and separate verification of your identity; or

If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us.

8. DO NOT TRACK

Some web browsers have “Do Not Track” features that allow you to tell a website not to track you. These features are not all uniform. The Website does not currently process or respond to “Do Not Track” signals.

10. CONFLICTS

This Privacy Notice is a supplement to, and is incorporated into, our U.S. Privacy Policy.
